Welcome to R1Resume! These Terms of Use ("Terms") govern your access to and use of the R1Resume web application (the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree with these Terms, you may not use the Service.

1. License

Subject to your compliance with these Terms, R1Resume grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal or professional use in connection with creating and managing resumes.

2. User Account and Registration

To access certain features of the Service, you may be required to create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security and confidentiality of your login credentials
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activities that occur under your account

3. User Content

You retain ownership of any content you submit, post, or display on or through the Service, including your resume data, personal information, and other materials ("User Content"). By submitting User Content, you grant R1Resume a worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, process, distribute, modify, adapt, and display your User Content solely for the purpose of operating and providing the Service, including processing your resumes through AI technology.

You represent and warrant that you have all necessary rights to your User Content and that your User Content does not violate any third-party rights or applicable laws.

4. Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity
  • Interfere with or disrupt the operation of the Service or servers or networks connected to the Service
  • Attempt to gain unauthorized access to any portion of the Service or any other systems or networks connected to the Service
  • Use any automated means (including bots, scrapers, or scripts) to access the Service without our express written permission
  • Upload or transmit viruses, malware, or any other malicious code
  • Violate any intellectual property rights of R1Resume or third parties
  • Use the Service to create resumes containing false, misleading, or fraudulent information
  • Abuse or misuse AI-powered features or attempt to game the system

5. Subscription and Payment

Certain features of the Service may require payment of fees. By subscribing to a paid plan, you agree to:

  • Pay all applicable fees as described in our pricing plans
  • Provide accurate and complete billing information
  • Authorize us to charge your payment method on a recurring basis

Subscription fees are non-refundable except as required by law or as expressly stated in our refund policy. We reserve the right to change our pricing with reasonable notice to existing subscribers.

6. Refund Policy

R1Resume offers a fair and transparent refund policy to ensure customer satisfaction:

  • 30-Day Money-Back Guarantee: If you are not satisfied with our Service, you may request a refund within 30 days of your initial subscription purchase. Refund eligibility depends on AI credit usage:
    • No AI Credits Used: Full refund (100%) if you have not used any AI credits from your subscription.
    • Partial AI Credits Used: Pro-rated refund based on unused AI credits. For example, if you used 50 out of 200 Pro credits, you will receive a refund for 75% of your subscription fee.
    • All AI Credits Used: No refund available if you have used all monthly AI credits allocated to your subscription tier.
    This guarantee applies only to your first subscription payment and does not apply to renewal charges.
  • Refund Eligibility: To request a refund, you must contact our support team at [email protected] within the 30-day period. You may be asked to provide feedback about your experience to help us improve our Service.
  • Renewal Charges: Subscription renewal charges are non-refundable. If you wish to cancel your subscription, you must do so before your next billing date to avoid being charged. You will retain access to premium features until the end of your current billing period.
  • AI Credits: Purchases of additional AI credits or one-time feature upgrades are non-refundable once the credits have been used or the features have been accessed.
  • Processing Time: Approved refunds will be processed within 5-10 business days and will be credited to the original payment method used for the purchase.
  • Abuse Prevention: We reserve the right to deny refund requests that we determine, in our sole discretion, to be fraudulent, abusive, or in violation of these Terms.

7. AI-Powered Features

The Service includes AI-powered features for resume review, optimization, and matching. While we strive for accuracy, you acknowledge that:

  • AI-generated suggestions are automated and may not be perfect
  • You are solely responsible for reviewing and approving all content in your final resume
  • R1Resume is not liable for any outcomes resulting from AI-generated content or suggestions

8. Intellectual Property Rights

The Service and its content, including but not limited to text, graphics, logos, software, templates, and design elements, are the property of R1Resume or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our express written permission.

9. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the Service will immediately cease. You may also terminate your account at any time by contacting us.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. R1RESUME DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

R1Resume does not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL R1RESUME BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

R1Resume's total liability to you for all claims arising from or related to the Service shall not exceed the amount you paid to R1Resume in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless R1Resume, its affiliates, officers, directors, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with:

  • Your use of the Service
  • Your User Content
  • Your violation of these Terms
  • Your violation of any rights of another party

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court for intellectual property infringement.

14. Changes to Terms

R1Resume reserves the right to update or modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Service and updating the "Effective Date" above. Your continued use of the Service after the posting of updated Terms constitutes your acceptance of the changes.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and R1Resume regarding the Service and supersede all prior agreements and understandings.
